1. People applying for visas that must be granted outside Australia
Certain visa categories are designed to be granted only while the applicant is outside Australia.
However, there is an exception to this rule. If the individual has a sponsor, such as in the case of a visitor visa, where the person will visit family in Australia. In such instances, the sponsor can often lodge an appeal if the visa application is refused.
2. Applicants who applied for the visa from outside Australia
Similarly, individuals who applied for a visa while they were outside Australia and subsequently received a refusal are typically unable to lodge an appeal for that refusal. The ART generally does not have jurisdiction in relation to visa applications lodged from overseas. However it may be possible for your sponsor to appeal the decision for you.
3. Individuals who are outside Australia when applying for the Appeal at the ART
Lastly, individuals who are outside Australia at the time of lodging an appeal with the Administrative Review Tribunal (ART) are generally unable to proceed with the appeal process. The ART typically requires appellants to be physically present in Australia when applying for the appeal.
