What if your occupation is not on the 482 core skills occupation list?

One of the most frustrating situations for an employer and an overseas worker is finding out that the occupation they want to nominate is not on the relevant skilled occupation list. However this does not mean that employer sponsorship is impossible. Other options including checking other lists; applying in the specialist stream; using a DAMA or applying for a labour agreement.

Consider a regional employer

If your employer is willing to employ you in a designated regional area, a subclass 494 may be an option.

The advantage is that the 494 visa has a different occupation list with more options than the 482.

A lot of Australia is considered to be regional for this visa, including outer suburbs of larger cities such as Brisbane.

Consider the Specialist Skills stream

Another option is the Specialist Skills stream of the Skills in Demand visa (subclass 482). The Specialist Skills stream does not use the Core Skills Occupation List in the same way as the Core Skills stream.

Instead, the nominated occupation must be in ANZSCO Major Groups 1, 2, 4, 5 or 6 and the nominated salary must meet the Specialist Skills Income Threshold.

For nominations lodged from 1 July 2026 to 30 June 2027, the current Specialist Skills Income Threshold is $146,576 per annum plus superannuation.

Consider a labour agreement

If the standard skilled visa programs do not provide a pathway, the employer may be able to consider a labour agreement.

Labour agreements allow approved businesses to sponsor overseas workers where there is a demonstrated need that cannot be met through the Australian labour market and where standard temporary or permanent visa programs are not available.

Labour agreements can be used for:

  • Skills in Demand visas (subclass 482);

  • Employer Nomination Scheme visas (subclass 186); and

  • Skilled Employer Sponsored Regional visas (subclass 494).

There are different types of labour agreements, including:

  • industry labour agreements;

  • Designated Area Migration Agreements (DAMA); and

  • company-specific labour agreements.

A labour agreement can therefore provide a pathway where the standard occupation list does not. However, obtaining a labour agreement is an employer process. It is not something an individual worker can simply apply for on their own. The employer needs to demonstrate why the agreement is necessary and satisfy the relevant requirements.

Consider a DAMA

A DAMA, or Designated Area Migration Agreement, can be particularly useful if the employer is located in an eligible regional area.

DAMAs provide access to a broader range of occupations than the standard skilled migration program.

There are currently a number of DAMAs operating across Australia, each covering a particular geographic area.

Check whether another ANZSCO occupation fits your actual job

Sometimes the problem is not that the occupation is genuinely unavailable. The problem may be that the wrong occupation has been selected.

Australian skilled visas use ANZSCO occupation classifications. Your job title does not necessarily determine your nominated occupation. What matters is whether the actual tasks and responsibilities of your position correspond to an eligible ANZSCO occupation.

For example, an employee might have a job title that is not on the list, but their actual duties could potentially fall within a different occupation that is eligible.

Get advice before giving up on employer sponsorship

Finding an employer who is willing to sponsor you can often be your best option for staying in Australia, and the subclass 482 visa in the core skills stream is often the most common starting point. However if your occupation is not on the list, there might still be another option for you.
