Why you shouldn’t just renew your 461 visa

The Subclass 461 New Zealand Citizen Family Relationship Visa is a fantastic visa option for many people. It’s affordable, generally processed quickly, and allows the holder to live and work full-time in Australia. Even better, you can keep renewing the 461 visa as long as you are either in a relationship with a New Zealand citizen—or not in a relationship at all.

But here’s the important part: the 461 visa is a temporary visa. And while it has great advantages, relying on it long-term without a migration plan may leave you with fewer rights, less security, and no pathway to citizenship.

461 is temporary—and temporary visas have limits

Unlike permanent visas, temporary visas come with uncertainty. You are not guaranteed to stay in Australia forever, and temporary visa holders:

• Are not eligible to apply for Australian citizenship

• Can have their visas cancelled more easily than permanent residents—for example, if you get a criminal record

Use your 461 time to build a long-term migration plan

Instead of simply renewing your 461 visa every five years, consider using this time to prepare for permanent residency. Permanent visas offer long-term stability, a path to citizenship, and greater rights. Here are two strong options for 461 visa holders:

1. Partner visa pathway (subclass 820/801)

If your New Zealand partner becomes an Australian citizen, you may be eligible to apply for a partner visa (820/801). This is a permanent visa pathway and eventually leads to citizenship. It can take time to prepare and lodge this application, so it’s best to plan ahead.

2. Employer-sponsored permanent visa (subclass 186 Direct Entry)

The subclass 186 visa (Direct Entry stream) is another excellent option. And here’s a major benefit for 461 holders: you do not need to complete a skills assessment if applying from a 461 visa.

To qualify, you’ll need:

• An occupation on the Core Skills Occupation List

• Two years of relevant work experience

• A willing employer sponsor

• Competent English

• You can also be over 45 years old—something that isn’t possible for most other applicants
